Uploader Agreement

Read this before you upload anything. It is short, and it matters: by uploading to ShitVid you are taking on the legal responsibilities of a producer. We host; you produce.
1. Who does what
ShitVid (operated by Brown Media LLC, "we") provides transmission, storage, retrieval, hosting and formatting of content that users choose to upload. We do not create, commission, select, edit or alter that content. We are therefore not a "producer" — primary or secondary — of any content on this site within the meaning of 18 U.S.C. §2257 and §2257A, as provided by §2257(h)(2)(B), and we do not maintain records under 28 C.F.R. Part 75 for user content.
You are the producer of everything you upload. You, not we, are the person responsible for compliance with 18 U.S.C. §§2257 and 2257A and 28 C.F.R. Part 75, and with every other law that applies to producing and publishing the content in the place where you made it and the place where you live.
2. Your records
For every video you upload that depicts actual or simulated sexually explicit conduct, you confirm that you have created and will keep, for as long as the law requires, the records that a producer must keep, including: a legible copy of a government-issued photo identification for every person depicted, showing their legal name and date of birth; every other name (stage names, aliases, nicknames) each person has used; and the date the content was produced. You confirm that you keep those records where they can be produced if a lawful request is made.
You are the custodian of those records. We do not hold them and we will not ask for them as a condition of uploading. Requests for records about your content will be directed to you. If a lawful request reaches us for records relating to your content, you agree that we may pass on to the requester the contact details and upload log we hold for your account.
3. What you promise about every upload
Each time you upload, you confirm on the upload form, and you promise to us and to every person who views the site, that:
- every person depicted was at least 18 years old (and above the age of majority where the content was made) at the time of production, and you have checked their government-issued photo ID to confirm it;
- every person depicted gave informed consent to being recorded, and to the content being published on this site, and has not withdrawn it;
- you produced the content yourself or otherwise hold every right needed to publish it here, and it is not copied from another creator, site or studio;
- the content is legal to produce, possess and distribute in the United States and in the place where you are, and does not break the Community Guidelines.
We log each attestation together with your account, the time, your IP address and the version of this agreement. That log is our record that you accepted responsibility for the upload.
4. Nothing that shouldn't be here
Do not upload anything depicting a minor, anything non-consensual, or anything made or shared without the depicted person's consent. Every upload is scanned automatically against known abuse-material hash databases before it is published. A match is reported to the NCMEC CyberTipline as the law requires, the account is closed permanently, and we cooperate with law enforcement. There is no appeal from that.
5. Removal, reports and appeals
Because we do not review content before it goes live, we rely on reports. Anyone — with or without an account — can report content, and a person who appears in a video can ask for it to be removed through Report content; requests concerning intimate imagery shared without consent are actioned within 48 hours (TAKE IT DOWN Act). We may remove content or restrict accounts at any time under the Guidelines, and we give reasons and an appeal route for policy-based decisions. Removal for legal reasons is not appealable through the site.
6. Responsibility and indemnity
You are responsible for your uploads. If anyone brings a claim against Brown Media LLC, its owners, staff or volunteers arising out of content you uploaded — including any claim that you failed to keep records, that a depicted person was under age or did not consent, or that you did not own the rights — you agree to defend and indemnify us and to pay any resulting losses, costs and reasonable legal fees.
7. No verification by us; no payments
We do not verify your identity or age beyond your statements in this agreement and on the upload form, and we do not process payments or take a share of anything. We may carry advertising to cover the cost of running the site. Nothing here creates a partnership, employment or agency relationship between you and us.
8. Changes
If we change this agreement you will be asked to accept the new version before your next upload. Content uploaded under an earlier version stays subject to the promises you made under that version.
