Draft for legal review. Operated by Brown Media LLC. The Uploader Agreement is part of these Terms for anyone who uploads.
1. Adults only
You must be at least 18 years old and the age of majority where you live to use this site. Do not use the site where adult material is illegal, or from any jurisdiction where we have made the site unavailable.
2. What this site is
ShitVid is a hosting platform for content that users choose to upload. We provide transmission, storage, retrieval, hosting and formatting of that content. We do not create, commission, select, edit or alter it, and we do not review it before it is published. Content is published automatically once automated screening for known illegal material has passed. We are an intermediary, not a publisher or producer, and we are not a primary or secondary producer of any content within the meaning of 18 U.S.C. §2257 (see our §2257 statement).
3. Your account
Keep your password secure; you're responsible for activity on your account. One account per person. We may suspend or terminate accounts that violate these terms or our Community Guidelines.
4. Content you upload — you are the producer
To upload you must first accept the Uploader Agreement. In summary: you are the producer of everything you upload and the custodian of the records that 18 U.S.C. §§2257–2257A and 28 C.F.R. Part 75 require a producer to keep; we do not hold those records and requests for them will be directed to you. For every upload you confirm that every person depicted was 18 or older at the time of production and that you have checked their government-issued ID, that every person depicted consented to recording and to publication here, that you produced the content or hold the rights to publish it, and that it is legal where you are and where it was made. Each of those confirmations is logged with your account, the time and your IP address.
You keep ownership of what you upload. You grant Brown Media LLC a non-exclusive, worldwide, royalty-free licence to host, transcode, display and distribute it on this site for as long as it's published here (plus any retention the law requires).
5. Prohibited content and conduct
See the Community Guidelines. In particular: no minors, no non-consensual content, no content illegal under US law, no harassment, no scraping or bulk downloading, no circumventing moderation or geo-restrictions.
6. Reports, removal and appeals
We rely on reports rather than pre-screening. Anyone may report content at Report content. A person depicted in intimate imagery published without their consent may request removal there and we will remove it, and reasonable duplicates, within 48 hours. We may remove content or restrict accounts at any time under the Guidelines; we give reasons for policy-based decisions and provide an appeal reviewed by someone not involved in the original decision. Legally mandated actions are not appealable through the site.
7. Responsibility and indemnity
You are solely responsible for content you upload and for complying with every law that applies to producing and publishing it. You agree to defend and indemnify Brown Media LLC, its owners, staff and volunteers against any claim, loss, cost or reasonable legal fees arising from content you uploaded, including any claim relating to the age, identity or consent of a person depicted, to record-keeping, or to rights in the content.
8. No payments on this site
We do not sell subscriptions or process payments. Any paid relationship between you and a creator on an external site is between you and that site. Advertising and outbound affiliate links are labelled; advertising exists to cover the cost of running the site.

10. Disclaimers and liability
The site is provided "as is". To the fullest extent permitted by law, Brown Media LLC disclaims all warranties and is not liable for indirect or consequential damages arising from use of the site or from user content. Nothing in these terms limits the protection available to Brown Media LLC as an interactive computer service under 47 U.S.C. §230 or as a service provider under 17 U.S.C. §512.
11. Changes
We may update these terms; material changes will be announced on the site, and uploaders will be asked to re-accept the Uploader Agreement when it changes.
