Exemption statement

ShitVid, operated by Brown Media LLC, is a platform for user-generated content. Brown Media LLC is not a producer — primary or secondary — of any of the visual content appearing on this website within the meaning of 18 U.S.C. §2257, §2257A or 28 C.F.R. Part 75.

The activities of Brown Media LLC with respect to that content are limited to the transmission, storage, retrieval, hosting, formatting and translation of communications, without selection or alteration of the content, as described in 18 U.S.C. §2257(h)(2)(B)(v). Content is uploaded by users, is not commissioned, created, edited or selected by Brown Media LLC, and is published automatically once it has passed automated screening for known illegal material. Brown Media LLC is therefore exempt from the record-keeping and labelling requirements of §2257 and §2257A and does not maintain records under 28 C.F.R. Part 75 for user content.

Who the producer is

The user who uploads a video is the producer of that video. As a condition of uploading, every user accepts the Uploader Agreement, under which they confirm that every person depicted was at least eighteen (18) years old at the time the content was produced, that they hold the records required by 18 U.S.C. §2257 and 28 C.F.R. Part 75 for every person depicted, and that they are the custodian of those records. Each individual upload is accompanied by a further logged attestation to the same effect.

Requests for records

Brown Media LLC does not hold §2257 records and has no custodian of records. Requests for records relating to a specific video should be directed to the uploader of that video, who is identified on the video's page. A lawful request received by Brown Media LLC will be forwarded to the uploader, and Brown Media LLC will cooperate with law enforcement as required by law.

Illegal content

Brown Media LLC has zero tolerance for child sexual abuse material and non-consensual content. Every upload is screened against known-abuse hash databases before publication; matches are reported to the National Center for Missing & Exploited Children as required by 18 U.S.C. §2258A.
